Terms and conditions

This Endeavour platform is owned and controlled by the Board of Trustees of the Royal Botanic Gardens, Kew (“RBG Kew”, “we” or “us”) and use of the platform is subject to RGB Kew's terms and conditions. In the event of any inconsistency, these terms shall prevail. 

Registration and access

Registration information

We will use the information you submit to register your institution (referred to as “you” or “your”) on Endeavour, our challenge based learning platform, and identify you as the primary contact to keep you informed about your school’s progress, deal with queries, obtain feedback, and provide other information that may be relevant or of interest to your school or organisation.  Kew’s privacy policy can be found here: https://www.kew.org/about-our-organisation/our-policies/privacy-policy

Use of the platform

The purpose of this platform is to provide on-line learning resources which are linked to the English National Curriculum for use within classrooms and school grounds in the UK, or on-site at Kew Gardens during booked visits.  It is intended that content will also be uploaded by you including results of challenges and content generated by pupils.  This content will be visible to you and to us (and our service providers), but not to any other institutions or users. 

Removal of material

You agree to ensure that no content you submit to the platform is illegal, defamatory, obscene, discriminatory or likely to either offend or incite hatred, breach the copyright of any third party or be damaging to our or any third party software, IT systems or data.  We reserve the right to remove any content that, in our sole discretion, we believe contravenes, or is likely to contravene, these principles.

Access

We will use our reasonable endeavours to ensure that maintenance is undertaken at a time which minimises disruption to users and, where possible, outside of normal working hours (being 9-5, Monday to Friday).  However, we reserve the right to undertake emergency maintenance or to restrict or revoke your access to this platform, or any part of it, at any time and without advance notice. 

 

Content: use and ownership

This platform contains text, images and intellectual property (such as our name and logo) owned by us and / or produced by third parties that have either given their permission for it to be used on this platform or have waived their rights to such content.  You are not permitted to use the content on this platform for any other purpose other than your school’s educational purposes and you are not permitted to edit, manipulate or reproduce the content elsewhere, including on another website.

Kew / Free to use content

Where content is downloadable, you are granted a royalty free licence to use, download and reproduce this content for your school’s educational purposes only.  [Where any materials include a copyright mark or statement, please ensure that your reproduction and use of these materials includes the copyright statement and acknowledges this platform as the source of your content].

Some content on this site is not subject to copyright at all.  This is because copyright has either been waived or has expired and as such it has been placed in the public domain under Creative Commons – learn more about this here https://creativecommons.org/publicdomain/zero/1.0/

Third party content for display only

Some content (mainly images) may be restricted and you will find it cannot be downloaded or printed.  This is because it is subject to a limited licence and so you are only permitted to view or display it.  It can be identified by the fact that it will include an appropriate copyright statement and / or accreditation on or within the image.  Your use of this content is subject to you displaying this content as it is presented on our site, so you must ensure that all copyright statements and credits remain visible and readable. 

Your content

We also recognise that you will upload or submit to us, by various routes, your own text, images and videos, those of your pupils and any other third party content (referred to collectively as “your content”).  You, your pupils and any other third parties shall retain ownership of such content. 

Our use of Your content

You grant us a non-exclusive, royalty free, worldwide licence to display, download, reproduce, copy and use your content for the purposes of providing you this platform and any related support activities.  This includes commenting on content, providing feedback and using things we’ve learnt about your interactions to make improvements to this platform.  You hereby confirm that you have appropriate pupil or other third party consent for the use of any personal data which may be included in any content that you upload, such as images or photos of individuals.  We agree that we will not reproduce your content elsewhere and if we would like to use any of your content for any other purpose, we will seek your permission to do so.

 

No warranty re use of site or content

No warranty

Whilst we have taken appropriate steps to ensure the integrity of this platform and its content, we do not give any warranties as to its use, including that it is free of viruses, the content is accurate or complete, that your access will be continuous or error free or that content submitted will be secure or backed up.

Viruses

We shall not be responsible for any viruses, code, files or programmes designed to interrupt, destroy or otherwise limit the functionality or compromise the integrity of any system or equipment that may be transmitted as a result of your access.  Please note that you are responsible for ensuring you have installed adequate virus checking software.

Third party sites

We are not responsible for the content of any third party sites that we may link to for convenience, so please check the terms and conditions of any site before accessing.

No back-ups

Please ensure that you have back-ups of any content that you upload or otherwise submit to us in relation to your use of the platform.
